2nd ex-NYPD officer faces sentencing on misconduct misdemeanor after rape acquittal

NEW YORK (AP) ' A second former New York City police officer is set to find out whether he will be jailed on a misconduct conviction after he and his partner were acquitted of raping a woman they were summoned to help.

Franklin Mata is due to be sentenced Wednesday. He could get up to two years in jail or no time behind bars.

Ex-partner Kenneth Moreno was sentenced Monday to a year in jail. He's free during a planned appeal.



The two were called to help the drunken woman get out of a cab in December 2008.

The woman said she awoke to being raped after passing out. Moreno said he cuddled with her in her bed, but there was no sex. Mata said he was napping on her sofa.
