Court seeks more info in Honda small claims case
Court orders 2nd hearing and more evidence in Honda hybrid small claims lawsuit

LOS ANGELES (AP) ' A second court hearing has been ordered in a Los Angeles woman's small claims suit alleging her hybrid Honda Civic failed to deliver the promised 50 miles per gallon.

Los Angeles County Superior Court Commissioner Douglas Carnahan on Tuesday asked for additional legal arguments and scheduled a hearing for Jan. 25.

Carnahan wants to know whether there is a statute of limitations problem in the fraud suit by Heather Peters, who purchased her car in 2006.



The commissioner also refused to consider a brief filed by Honda's chief counsel because litigants are not allowed to have lawyers in small claims court.

Peters, a former lawyer, took the unique action of opting out of a class-action suit involving thousands of hybrid Honda owners. She seeks $10,000 in small claims court.
