Court: Judges can rule on passport law
Justices: Courts should decide whether Jerusalem-born Americans can list Israel as birthplace

WASHINGTON (AP) ' The Supreme Court says whether a Jerusalem-born American can have his U.S. passport show that he was born in Israel can be decided by the courts, not politicians.

The justices on Monday overturned a ruling saying the court can't judge a federal law that give Americans born in Jerusalem the right to have Israel listed as their birthplace.

The case mixed Middle Eastern politics with a dispute between Congress and the president. The parents of Jerusalem-born Menachem Zivotofsky sued the State Department after it wouldn't issue the boy a passport showing he was born in Israel. The U.S. has refused to recognize any nation's sovereignty over Jerusalem since Israel's creation in 1948.



The federal appeals court called it a political matter. The court overturned that on an 8-1 judgment.
