Prosecutors urge judge to void subpoenas issued by lawyers for Tucson shooting rampage suspect
PHOENIX (AP) ' Prosecutors urged a judge to void subpoenas issued by lawyers for the Tucson shooting rampage suspect because they say defense attorneys served the documents without court approval.
Prosecutors say Wednesday that Jared Lee Loughner's lawyers broke court rules in issuing subpoenas for a lease from an apartment complex where Loughner once lived and for birth and death records for some Loughner's relatives.
Loughner's attorneys say they received court approval for the subpoenas.
U.S. District Judge Larry Burns will consider the subpoena dispute at a hearing Friday.
Loughner has pleaded not guilty to 49 charges in the Jan. 8 shooting that killed six people and wounded 13, including Rep. Gabrielle Giffords.
