Judge: Conn. home invasion victim can attend trial
Judge: Man whose wife, daughters were killed in Conn. home invasion can attend upcoming trial

NEW HAVEN, Conn. (AP) ' A Connecticut judge says a man whose wife and two daughters were killed in a 2007 home invasion can be in the courtroom while other witnesses testify at the upcoming trial of one of the accused.

New Haven Superior Court Judge John Blue on Monday ruled against a motion by Joshua Komisarjevsky (koh-mi-sahr-JEFF'-skee) to sequester Dr. William Petit, the sole survivor.

Defense attorneys say Petit referred to testimony of earlier witnesses while testifying in the trial of a co-defendant, Steven Hayes, and corrected what others had said.



Prosecutors say Petit has given consistent testimony, would not be affected by other witnesses and has a right to attend the trial as a victim.

Komisarjevsky's trial starts next month. Hayes was convicted last year and is on death row.
