Pa. woman appeals federal collar bomb plot conviction on mental health issues, statements
By The Associated Press

PITTSBURGH (AP) ' A Pennsylvania woman sentenced to life in prison for a bizarre bank robbery plot in which a pizza delivery driver was killed by a bomb locked around his neck wants an appeals court to grant her a new trial on grounds that she wasn't mentally competent to stand trial, among other issues

The 49-page appeal on behalf of 62-year-old Marjorie Diehl-Armstrong was electronically filed late Friday and received Monday by the 3rd U.S. Circuit Court of Appeals.

The appeal focuses largely on the decision by U.S. District Judge Sean McLaughlin to find Diehl-Armstrong competent for her trial after the same judge initially determined that her mental illnesses made it impossible for her to assist in her defense.

Diehl-Armstrong was convicted last November for her role in the plot that killed Brian Wells when the bomb locked onto his neck exploded on Aug. 28, 2003.
