Hung jury on rape charges a day after NYPD officer convicted of sex assault against teacher
NEW YORK (AP) ' A jury has deadlocked on rape charges a day after an off-duty New York City police officer was convicted of sexually assaulting a schoolteacher he grabbed off the street.
The Manhattan district attorney said Wednesday that jurors "did not reach consensus" on two counts of rape and two related charges against Michael Pena.
On Tuesday, he was convicted of charges including the top count, predatory sexual assault. It's punishable by up to life in prison.
Pena admitted sexually attacking the woman but said he didn't have intercourse with her during the August assault.
The woman testified that Pena ordered her into a courtyard and threatened to shoot her if she resisted.
The defense said the victim was in such "abject terror" that she was mistaken about the extent of what happened.
